Public Employee’s criminal conduct falls outside the scope of her employment with a Public Entity

The Castañón Law Group successfully convinced a Los Angeles Superior Court Judge that a Public Employee’s criminal conduct falls outside the scope of her employment with a Public Entity

The Honorable Frederick C. Shaller of the Los Angeles Superior Court ordered plaintiffs to amend their multi-million dollar complaints in suits filed against the City of Montebello after a former police records clerk leaked information about plaintiffs to her cousin. The case is a “longshot” to reach a jury.

At a hearing held December 7, 2015, Judge Shaller granted Defendants’ demurrers and ordered plaintiffs, “to come up with something more than the mere fact that this employee committed a crime while being employed.” Shaller continued, “Even though I’m very sympathetic, I don’t feel under the law that I can hold the City of Montebello responsible.” The Castañón Law Group represents the City of Montebello.
